On September 18, the Guiyang Intermediate People's Court publicly sentenced defendant Yu Huaying on the crime of abducting and selling children. Defendant Yu Huaying was sentenced to death for child abduction, deprived of political rights for life, and sentenced to confiscation of all personal property.

After trial, it was ascertained that between 1993 and 1996, the defendant Yu Huaying and Gong Mouliang (deceased) roamed around Guizhou Province, Chongqing Municipality and other places in order to seek illegal profits, looking for suitable children to abduct and sell.

The Guiyang Intermediate People's Court held that the defendant Yu Huaying's repeated abduction and trafficking of children in order to seek illegal profits constituted the crime of abducting and selling children, and the circumstances of the crime were particularly serious, and the harm to society was extremely great, and should be severely punished. The above judgment was accordingly.

Defendant Yu Huaying appealed in court.

"Face-changing" neighbors

Yu Huaying was identified and found by Yang Niuhua. Yang Niuhua, born in 1990 in Zhijin County, Bijie City, Guizhou Province, is the youngest daughter in the family. But for 26 years, Yang Niuhua had to live under another name, "Li Suyan".

Yang Niuhua recalled to China Newsweek that one winter in 1995, she was abducted and trafficked to Yaozhai Village, Yaozhai Township, Congtai District, Handan City, Hebei Province, to the home of a deaf and mute man. The man is in his thirties, and he and his old mother are dependent on each other. Yang Niuhua has a new name "Li Suyan", as well as a new "dad" and "grandma".

Yang Niuhua, 5, isn't entirely clear about what happened. She only knew that it was the woman Yu (Yu Huaying) who brought her here. "It was a woman with short hair, a smoking and a black trench coat, a very masculine person, and her daughter was about the same age as me." This Yu was renting next door to her house with a man at the time, and he was very good to himself and his sister, and would take the sisters shopping and buy them things.

One day, while Yang Niuhua's parents were not at home, Yu Huaying tricked Yang Niuhua out on the grounds of buying sweater needles. But Yu Huaying did not take her to the market to buy sweater needles, but took her to take several bus trips, changed her into tattered clothes near the train station, and then took Yang Niuhua to Handan, Hebei Province by train.

Yang Niuhua still remembers that after getting on the train, Yu Huaying immediately transformed into a fierce face. This face still impresses her to this day.

During this time, Yu Huaying not only punched and kicked Yang Niuhua, but also poured boiling water from the warm pot directly on her head, and La Yuetian only let her wear a pair of single pants to keep out the cold.

After Yu Huaying arrived at the case, Yang Niuhua knew from her confession that because she was a girl, the selling price of 2,500 yuan had not been "taken over" by a buyer in Handan, so Yu Huaying was very irritable.

Fortunately, the adoptive father was not bad for Yang Niuhua. Gradually, Yang Niuhua also learned to get along with this new family. The adoptive father's family lived very hard, with three adobe houses, sometimes leaking rain, and in their early years they relied on odd jobs.

After finishing the sixth grade, Yang Niuhua dropped out of school. A few years later, she started working outside the home. One thing she knew very well was that this home was not her real home. Yang Niuhua also thought that she might have been sold by her parents; If the parents did not look for it, they had forgotten themselves; But she prefers to believe that she was trafficked.

In 2012, Yang Niuhua began to search for relatives, seeking help from volunteer organizations and publishing information about finding relatives, and in 2013, blood was collected into the DNA bank, but there has been no progress.

Be sure to find you

On April 17, 2021, Yang Niuhua posted her family search information on a short video platform, and the photo was taken when she went to her adoptive father's house for a month.

She can recall the bits and pieces of her family, falling into a puddle and almost drowning, and her sister sat next to her crying after climbing up. Falling from the pigsty, her head bleeding, her sister carried herself on her back, crying and going to her mother.

"I'm 31 years old, I've been looking for you for 9 years, I'm afraid I won't find it again, I'm too old to repay my parents for the gift of life." She also sent a map of her hometown drawn based on memory, "I remember my name is Yang Niuhua or Yang Niu, there is a Yang Xinming's name in my memory, I don't know if it's my father, there is a dialect called Ah Budai, it seems to be calling grandma, I remember a Sang Ying, I don't know if it's my sister or my mother." ”

In the video, Yang Niuhua says, "Do you remember me? "I want to go home." At this time, she herself already had three children.

On May 3 of the same year, Yang Niuhua's video caught the attention of a girl surnamed Yang and Miao in Zhijin County, Guizhou Province, who had heard from her elders that a cousin had lost her in 1995. After DNA comparison and confirmation, Yang Niuhua, who had been abducted for 26 years, was finally reunited with her family.

Unfortunately, after Yang Niuhua was abducted, her biological father died in 1997 due to excessive drinking, and her mother died the following year because she could not bear the double blow. Later, she learned from her sister that at night, her parents would take her sister to the train station to find someone, and at night she would lay the roof at the station.

"When I didn't find a home, I never thought about going to traffickers. It was after finding his home that he found that there was such a big change in his home that he decided to find a human trafficker. Yang Niuhua recalled to China Newsweek.

In June 2022, Yang Niuhua found the Guizhou police and provided clues. Twenty-four days later, police from the Nanming branch of the Guiyang Municipal Public Security Bureau arrested Yu Huaying, who was suspected of abducting and selling Yang Niuhua.

Yang Niuhua recalled to China Newsweek that at that time, the police took out more than ten photos for Yang Niuhua to identify, and she recognized it at a glance, "That fierce face, not much changed from when she was young."

Wang Wenguang, Yang's lawyer and deputy director of Hebei Shili Law Firm, told China Newsweek that Yu Huaying, formerly known as Zhang Yun, was sentenced to eight years in prison by the Dayao County People's Court in Yunnan Province in 2004 for child abduction. He was released early in 2009. When she was found by the police again, she was living alone somewhere in Chongqing and did not appear to be working. Along with Yu Huaying, two men were abducting children, one of whom was dead and the other unaccounted for.

Later, the Nanming District Procuratorate of Guiyang City prosecuted Yu Huaying for the crime of "child abduction", and Yang Niuhua proposed 7.9 million yuan in civil compensation from Yu Huaying. However, according to Wang Wenguang, according to the sentencing recommendation provided by the prosecution, the defendant Yu Huaying voluntarily and truthfully confessed the facts of the crime, and had no objection to the alleged crime, and the prosecutor recommended a 14-year prison sentence and a fine.

Yang Niuhua was not satisfied with this sentencing recommendation, and she appointed a lawyer to transfer the case from the Guiyang Nanming District Court to the Guiyang Intermediate People's Court for trial, and increased the civil compensation to 8.8 million yuan. ”

The death penalty was pronounced

On July 14, the Guiyang Intermediate Court publicly heard Yu Huaying's suspected child abduction. The Guiyang Municipal Procuratorate prosecuted and charged that since 1993, the defendant Yu Huaying had collaborated with others to abduct and sell children in order to seek illegal benefits, and the circumstances were particularly serious.

"Initially, seven children were found to have been trafficked, and when they arrived at the Intermediate People's Court, four more children were added through police interrogation and information comparison," Yang told China Newsweek. According to Wang Wenguang, the 11 child trafficking cases charged this time do not include those that have been previously tried and concluded.

Yang Niuhua revealed to China Newsweek that in addition to the 11 children, Yu Huaying did not even let go of her own son, "just because it was her illegitimate son, and it was after this that she began to taste the 'sweetness' of child abduction."

Seeing Yu Huaying again, Yang Niuhua's feeling was still the fierce look in her memory. She did not think Yu Huaying had a repentant attitude, "she did not admit to abusing me and quarreled with me in court." At this trial, several parties who were abducted were also present.

On September 18, the Guiyang Intermediate Court rendered a first-instance judgment in the case. Yu Huaying committed the crime of abducting and selling children, the circumstances were particularly serious and the impact was particularly bad, and Yu Huaying was sentenced to death in the first trial and deprived of political rights for life.

After the first-instance verdict, the defendant Yu Huaying said in court that he was not satisfied with the judgment and would appeal.
